After the exam
Certificate of Practice
Clearing AIBE earns the Certificate of Practice, issued by the Bar Council of India. Enrolment makes you an advocate on the roll; the CoP is what permits you to practise before courts, tribunals and authorities.
Enrolment and the CoP are different things
| Enrolment | Certificate of Practice | |
|---|---|---|
| Granted by | State Bar Council | Bar Council of India |
| Under | Section 24, Advocates Act | On clearing AIBE |
| Effect | Name on the roll of advocates | Right to practise |
| Order | First | After |
Before the CoP arrives
An enrolled advocate who has not cleared AIBE remains on the roll but cannot practise. In practice many work as associates, in chambers, or in legal departments during this period. What they cannot do is appear.
Keeping it
The CoP is issued once and does not require renewal by examination. What continues is your obligation to the State Bar Council — the annual fee, and the standards of professional conduct in the BCI Rules. Breach of those is misconduct under Section 35 of the Advocates Act, whatever your AIBE score.
