§ 2(h) Contract Act

A contract

Section 2(h) of the Indian Contract Act, 1872. Section 10 sets out the essentials: free consent of competent parties, lawful consideration and lawful object, not expressly declared void.

§ 11 Contract Act

Void ab initio

Mohori Bibee v. Dharmodas Ghose (1903) settled that a minor's agreement is void from the beginning. It cannot be ratified on attaining majority, though a minor may be supplied necessaries under Section 68.

Coercion, undue influence, fraud, misrepresentation or mistake

Section 14 lists the five vitiating factors. Agreements caused by coercion, undue influence, fraud or misrepresentation are voidable; those caused by bilateral mistake of fact essential to the agreement are void.
