Section 4 of the Information Technology Act, 2000

Section 5 gives similar recognition to electronic signatures. The Act is based on the UNCITRAL Model Law on Electronic Commerce.

Computer-related offences committed dishonestly or fraudulently

Section 66 makes the acts referred to in Section 43, such as unauthorised access, downloading or damage, punishable when done dishonestly or fraudulently, with imprisonment up to three years or fine up to five lakh rupees.

The Supreme Court held the provision void for vagueness and overbreadth, violating Article 19(1)(a), as its terms were not covered by the reasonable restrictions in Article 19(2).
